Notice of Hearing
The Kansas Department of Health and Environment has prepared a draft Underground Injection Control Permit KS-05-155-002 for Advantek Cavern Solutions, LLC (ACS) in Hutchinson, Kansas.
The proposed action is to issue a five-year pilot permit for the emplacement of biosolids and other approved organics in a new well at the existing facility. The organic material will be mixed with saturated brine and injected through the inner tubing string into the open cavern space, brine from within the cavern will then be displaced and circulated to the surface between the inner tubing and casing. The displaced brine will be contained in above ground tanks for future use or injected into the Arbuckle Formation under the facility’s UIC Class I permit. The facility is in Section 14, Township 24 South, Range 6 West in Reno County, Kansas. A notice in the Kansas Register dated December 23, 2021, informed the public of the availability of the proposed Underground Injection Control permit for Advantek Cavern Solutions, LLC.
Copies of the permit application, the proposed KDHE permit, and other pertinent documents may be viewed in person at the Topeka Central office by scheduling an appointment, or copies requested by writing to Deb Biester, Kansas Department of Health and Environment, BOW-Geology and Well Technology, 1000 SW Jackson St., Suite 420, Topeka, KS 66612; or via telephone at 785-296-5524; or email at debra.biester@ks.gov. Appropriate copying charges will be assessed for each request.
A person may request a virtual public hearing be held on the proposed permit. The request for a public hearing shall be in writing and set forth the basis for the request. The written request must be submitted to Carrie Ridley, Unit Chief, Geology and Well Technology, KDHE BOW, 1000 SW Jackson, Suite 420, Topeka, KS 66612-1367, or email carrie.ridley@ks.gov and received no later than 5:00 p.m. January 24, 2022, in order for the Secretary of Health and Environment to consider the request. If no written requests are received, a public hearing will not be held. Registration for the tentative hearing does not constitute a request.
In the event a written request for a public hearing is received during the public comment period, a public hearing has been scheduled in conformance with Kansas Administrative Regulation 28-16-61 and 28-46-21.

Due to concerns regarding COVID-19, the public hearing, if requested, will be held online via Zoom. Documents and content related to the permit application, along with instructions and a link to register to attend the online public hearing is available at the Kansas Department of Health and Environment – BOW Draft Permits webpage at https://www.kdheks.gov/water/permit/index.htm. Persons wishing to attend the online hearing must register at least 12 hours before the start of the hearing.
The purpose of a public hearing is to inform the public, stakeholders, and regulated community about the proposed Underground Injection Control Permit. If requested, the hearing will consist of outlining the proposed facility and proposed permit, then the hearing will be open for public comment. Those attending virtually will be provided an opportunity to speak and provide oral comments on the proposed permit if they wish.
Those attending via Zoom or by phone at the number provided in your registration receipt will also be provided an opportunity to speak and provide comment on the proposed permit if they wish.
Any individual with a disability may request accommodation in order to participate in the public hearing process and may request the provided documents in an accessible format. Requests for accommodation to participate in the hearing process should be made at least five working days in advance of the hearing by contacting KDHE.
